THE POLITICAL ASSASSINATION OF TRUMP & THE 1ST AMENDMENT
The latest indictment of former President Trump and his team of lawyers is an event that, if successful, could forever alter the operation of our Constitutional Republic. Trump along with 18 members of his team were indicted on RICO charges. (One of them was former New York Mayor & Trump lawyer, Rudy Giuliani.) That’s the same statute that is used against organized crime syndicates. The Fulton County DA even admitted that the charges in the 96 page document are not illegal on their own. But because there are so many actions, they can be charged as a criminal enterprise. There are 41 charges in all, with 13 being laid specifically against Trump. The charges all center around the questioning of the results of an election. This happens all the time. Legal challenges are a necessary tool of democracy. These lawyers are accused of making false statements regarding the integrity of the election. They are charged with collecting the emails of public officials and then sending emails. They are charged with hiring forensic data demons to review results. They are charged with requesting hearings to challenge the results. And there were charges that un-named persons sent mean tweets.[i]
Constitutional lawyer and head of the American Center for Law & Justice, Jay Sekulow, explained the serious nature of this indictment. It criminalizes the practice of law. These were all legitimate election charges. [That doesn’t mean that they all could be proven true in a court of law. But nonetheless Trump’s lawyers were raising legitimate questions to be looked at in the courts – and all well-within the historical practice of American democracy.] Election challenges happen on a regular basis, even in national elections. Think of all the litigation that went on in 2000, the contest between Bush & Gore. Or remember how Hillary painted the Donald as being an “illegitimate president.” But these charges would serve to “chill the ability of lawyers to serve their clients.” This is starting to become a pattern. In procedures regarding January 6th, lawyers were named as “unindicted co-conspirators.”
Let’s just take Guiliani. He is being accused of “False statements and writings.” These occurred in the course of “advocating for the client. That is the basis [they are using] for a RICO charge. Their crime is they went to the hearings.” This is just “lawyers doing their jobs.” It gets more ridiculous. One of the counts against Trump alleges that he tweeted that there were election hearings going on and that they were being covered by the OAN network. This is what constitutes a ‘crime’ in the New Amerika. At least according to the new two-tiered justice system that exists.
